This Guarantee is a limited pilot program running through June 30, 2026. To be covered, your reimbursement claim must be submitted by that date — but don't worry: if you submit on time, we'll honor your claim all the way through the end of your state's review and appeals process, even if that extends past June 30, 2026. We won't accept new applications after June 30, 2026.
We want you to feel confident using your ESA funds on Outschool. We know that navigating state reimbursement programs can feel uncertain, and we think you shouldn't have to carry that risk alone. That's the whole idea behind this Guarantee.
These ESA Reimbursement Guarantee Terms (the "Guarantee") describe the circumstances in which Outschool, Inc. ("Outschool," "we," "us," or "our") will reimburse you for a qualifying purchase when your state's ESA or Scholarship program (collectively, “ESA”) denies your reimbursement request. It's subject to the conditions below, and it's part of our broader Terms of Service.
Definitions
A few terms show up throughout this document. Here's exactly what they mean.
"Appeals Process" The formal review or appeals procedure your state's ESA Program makes available if you want to challenge a Denial, including any deadlines and steps set by your state or its administering agency.
"Denial" A formal written notice from your ESA Program administrator rejecting a reimbursement request you submitted, after you've provided the required documentation. Note: a request for more information that hasn't been finally resolved isn't a Denial yet.
"Platform" Outschool's website(s), mobile app(s), and any related digital services where classes, tutoring, and other learning options are offered.
"Purchase" A completed transaction on the Platform for a class, service, or product that was designated as ESA-Eligible at the time you bought it, and that you paid for.
"Reimbursement" A payment we make to you under this Guarantee after a final Denial, subject to all the conditions and caps described below.
"User / you / your" The parent, legal guardian, or authorized account holder who made the Purchase on the Platform. This Guarantee is for you as the adult account holder, not the enrolled student. Your rights under this Guarantee are personal and can't be transferred to anyone else.
"ESA-Eligible" Outschool-hosted classes (live and self-paced), courses, and tutoring sessions.
"ESA Program" The Arizona Empowerment Scholarship Account program.
"Supported Jurisdiction" Arizona
Section 1. What This Guarantee Covers
Not every purchase is covered — here's how to know if yours is.
This Guarantee applies to Purchases where all four of the following were true at the time you registered for the Outschool offering: the Purchase was made on the Outschool Platform; the class, service, or product was designated as ESA-Eligible; it was offered by a teacher or provider listed and approved on the Platform; and it was connected to an ESA Program in a Supported Jurisdiction.
1.1 What Isn't Covered
This Guarantee doesn't apply to purchases that weren't labeled ESA-Eligible when you bought them, purchases made outside the Platform, purchases tied to programs or states we don't support, or any amounts you didn't actually pay out of pocket, like discounts, credits, or promotional value.
Section 2. What You'll Need to Do
If your state denies your claim, here's how to make sure you're in a position to request a Reimbursement from us.
2.1 Documentation We'll Need
To open a claim, you'll need to share a few things with us: the official written Denial notice from your ESA Program, your complete records showing what you submitted to the state, and any additional documents we may ask for as we review your claim.
2.2 Submit Within 30 Days of Your Denial
Once you receive a Denial from your state, you have thirty (30) days to submit your claim to Outschool. All applications for this ESA Reimbursement Guarantee must be submitted by June 30, 2026.
2.3 You Need to Have Done Everything Right on Your End
We can only step in if the Denial wasn't your fault. That means you followed your state's requirements, submitted accurate and complete paperwork on time, and participated in the process in good faith. We're not here to cover mistakes made along the way, but if you did everything right and still got denied, that's exactly what this Guarantee is for.
2.4 When We Can't Help
We won't be able to issue a Reimbursement if the Denial was caused by incomplete, inaccurate, or late submissions to the ESA Program; failure to follow your state's procedures; changes in state rules that happened after your Purchase; or any action or omission on your part that meaningfully contributed to the Denial.
Section 3. How We Review Your Claim
Here's what happens on our end once you've submitted.
We'll review every claim carefully, and we may reach out for additional information or documents as part of that process. Our determination on your claim is final, to the extent the law allows.
In some cases, we may ask you to first exhaust your state's appeals process before we process your Reimbursement. We know that can feel like extra steps, but it's important to give the state the opportunity to correct its decision before we step in. We'll let you know clearly if this applies to your situation.
Section 4. How to Submit a Claim
Submitting is straightforward — here's exactly how to do it.
4.1 Where to Submit
You can file your claim through any of these channels:
Claims sent through other channels may not be processed. We may update these options with reasonable notice.
4.2 What to Include
Please include the following in your submission:
• Your full name, your learner’s name, and the email address associated with your Outschool account
• The Outschool order or transaction ID for the Purchase
• A copy of the official Denial notice from your ESA Program
• Proof that you submitted a complete and timely reimbursement request to the state (e.g., a submission confirmation or timestamped records)
• If requested, a confirmation that you've completed any required appeals process, or a brief explanation of why no appeals process was available to you
If we need anything else, we'll reach out. If we do, please respond within 14 days, otherwise we may need to close your claim.
4.3 Keeping Your Records
We recommend holding onto copies of everything related to your state ESA submission and Denial for at least two years from the date of your Purchase.
Section 5. Reimbursement Limits
A few important numbers to know before you file.
We'll reimburse up to the actual amount you paid for the qualifying Purchase, we don't count discounts, credits, or promotional value toward that total. And across all claims in a calendar year, the maximum we'll reimburse any one account holder is five hundred dollars ($500.00).
We may adjust these caps going forward, but any changes will only affect future claims, not ones we've already approved.
Section 6. How We'll Pay You Back
Once your claim is approved, here's what to expect.
We won't process your Reimbursement until your state has issued a Denial and we may ask you to completed any required appeals process. After that, if your claim is approved, we'll get it processed within thirty (30) days. We'll issue your Reimbursement as a credit to your Outschool account. Credits expire ninety (90) days from the date of issuance.
Section 7. Keeping It Fair
This Guarantee works because families trust us — and we trust families. Here's what that means in practice.
Please don't submit duplicate claims for the same Purchase, misrepresent your situation or the documents you provide, or do anything intended to game or abuse this program. We reserve the right to request additional documents, verify your submission with your state's ESA Program where permitted, and audit any claim for compliance. If we find fraud, misrepresentation, or abuse, we can deny or reverse a Reimbursement, deactivate your Outschool account, and pursue all available legal remedies.
Section 8. How This Fits with Our Other Policies
A few notes on how this Guarantee sits alongside the rest of our policies.
8.1 No Double-Dipping
If you've already been made whole through a refund, a chargeback, insurance, or any other source for the same Purchase, this Guarantee won't apply, we're here to cover your actual loss, not to provide a windfall on top of a recovery you've already received.
8.2 Other Outschool Policies Still Apply
This Guarantee is an addition to our Terms of Service, Class Cancellation Policy and Refund Eligibility Guidelines, and Outschool Vouchers and GIft Card Policy, not a replacement for any of them. If there's ever a conflict, our Terms of Service control.
8.3 Your Privacy
When you submit a claim, you'll share personal information and sensitive documents with us — things like official government denial notices and financial records. We handle all of that in accordance with our Privacy Policy. By submitting a claim, you're consenting to our collecting and using that information to evaluate and process it.
Section 9. A Few Important Things to Know
We want to be upfront about what this Guarantee is — and what it isn't.
9.1 This Is a Conditional Promise, Not a Blanket One
This Guarantee only applies when the specific conditions throughout this document are met. It's not an unconditional promise of Reimbursement for every denied ESA claim, and it's not a substitute for following your state's process carefully.
9.2 "ESA-Eligible" Doesn't Mean Your State Will Automatically Approve It
When we mark a class or product as ESA-Eligible on the Platform, that reflects our good-faith assessment based on the information we have. But your state's ESA Program has the final word on every reimbursement request, we can't override that. If your state disagrees with our classification and denies your claim, this Guarantee exists precisely for that situation. But we can't promise approval, and we're not representing that we can.
9.3 We're Independent from Your State's ESA Program
Outschool is a private company. We're not affiliated with, endorsed by, or acting on behalf of any state or state-run ESA program. We don't control any state's policies or decisions, and this Guarantee is entirely our own commitment to you, separate from anything your state offers.
Section 10. Pilot Program Details
What you need to know about the timing and our ability to change this program.
This is a pilot program with a firm deadline: we won't accept new applications after June 30, 2026. If you submit by that date, we'll see your claim through to the end, even if your state's appeals process takes longer than expected.
We may also need to modify, pause, or end this program at any time, or adjust who qualifies and what the limits are. If we make meaningful changes, we'll let you know through the Platform or by email. Any changes apply going forward only, they won't affect claims we've already approved.
Section 11. Limits on Our Responsibility
We're committed to honoring this Guarantee — but we want to be clear about its scope.
To the fullest extent the law allows, our total responsibility under this Guarantee won't exceed the Reimbursement caps in Section 5. We're also not responsible for indirect or consequential losses (like missed learning opportunities or lost time) even if they were connected to a denied ESA claim.
Section 12. Legal Housekeeping
Standard legal provisions that apply to this Guarantee.
12.1 Effective Date
This Guarantee is effective as of June 2, 2026 and applies to Purchases made on or after that date through June 30, 2026.
12.2 Severability
If any part of this Guarantee turns out to be unenforceable, that part will be modified just enough to make it work, or removed entirely if it can't be fixed, without affecting the rest of the document.
12.3 No Waiver
If we don't enforce a particular provision at some point, that doesn't mean we've given it up permanently. We can still enforce it in the future.
12.4 Entire Agreement
This Guarantee, together with our our Terms of Service, Class Cancellation Policy and Refund Eligibility Guidelines, and Outschool Vouchers and GIft Card Policy, makes up the complete agreement between you and Outschool on this subject. If there's a conflict, our Terms of Service control.
12.5 Assignment
Your rights under this Guarantee are personal to you, they can't be transferred or assigned to anyone else without our written consent. We may assign this Guarantee in connection with a merger, acquisition, or sale of our business.
12.6 How We'll Notify You of Changes
If we make material changes to this Guarantee, we'll post the updated version on the Platform and, where practical, send you an email at the address on your account. Keeping your account email current ensures you won't miss anything important.
Section 13. Governing Law
This Guarantee is governed by the same law specified in our Terms of Service.
